The Wills Register Terms and Conditions

  1. The Proprietor of this website, and the provider of the online will writing service is South Eastern Estates Ltd trading as The Wills Register PO Box 331 Folkestone Kent CT20 2GH registration number 01917371 (telephone 01303 248644) and is referred to throughout as "The Wills Register", "we" or "us". "You" means the individual using The Wills Register Will writing service ("the Service"). In the case of mirror wills both persons who produce a will shall be considered "you" for the purpose of these terms and conditions and will be held jointly and severally liable. "The Site" means The Wills Register website or app as applicable and "Questionnaire" means The Wills Register on-line or in app questionnaire completed by you. "Will" means the will prepared by us and purchased by you as a result of using the Service. Please read these terms and conditions carefully before you start to use The Wills Register site. By using our site or purchasing a will from us, you confirm that you accept these terms and conditions of use and that you agree to abide by them.
  2. The Service is only suitable if you have your permanent home in England or Wales, you are over 18 years of age, you understand the English language, you understand the nature and purpose of making a will, the extent of your estate and you are aware of and have considered those that may lay claim to your estate. You confirm that you are acting of your own free will and not subject to any coercion or any undue influence. We accept no responsibility for verifying any of the above or your identity. The Service does not provide legal advice.
  3. The Wills Register reserves the right to refuse to process any submitted questionnaire or prepare any will at its absolute discretion. In such cases we will refund any payment made by you.
  4. The will is prepared in accordance with the laws of England and Wales and is not suitable for use outside this jurisdiction or for assets situated outside this jurisdiction.
  5. If you provide information on the questionnaire about another person or other people you hereby confirm that you have their permission to give us their details and for it to be used in the preparation of your will.
  6. The Wills Register will produce your will in reliance upon the information submitted by you in your completed questionnaire and will not be liable for any inaccuracies, omissions, errors, false statements or otherwise and you or your estate agree to indemnify The Wills Register in respect of any claim arising therefrom.
  7. The Wills Register accepts no responsibility or liability whatsoever for any loss caused by or connected with:
    1. Any loss caused by any computer virus transmitted to you from The Wills Register site.
    2. Any loss caused should the will be lost or delayed in the post, any loss or delay of any email transmission.
    3. The content of any website linked to the Wills Register site.
    4. Any assets situated outside of England & Wales.
    5. Any alterations or additions you make to your will after the completion of the service.
    6. Your non-compliance with these terms and conditions.
  8. It remains your responsibility to ensure the correct execution of your will. You confirm that you have sufficient testamentary capacity to understand that you are making a will and that when you sign it you do so with full knowledge and approval of its contents. The Wills Register will provide with the will comprehensive instructions for execution of the will which must be strictly adhered to. The Wills Register accepts no responsibility or liability whatsoever for any loss whatsoever arising out of a failure to fully observe and implement the detailed instructions for execution of your Will.
  9. Refunds and right to cancel: You have the right to cancel your will by contacting us and confirming your intention to cancel within seven working days of purchase. In such circumstances we will refund any charge in full. If the will has been sent to you within that seven day period as a matter of urgency the will must be returned to us in its original envelope unopened or no cancellation will be accepted. Payment will only be accepted by Credit Card in your name and refunds will only be made to that card.

  11. The Wills register is registered under the Data Protection Act 1998. The personal information which we hold will be held securely in accordance with our internal security policy and the law. You are responsible for maintaining the confidentiality of your password when applicable or the security of your own iPad if applicable or other device. Personal Data will not be used for any purpose other than the preparation of the will and any/if any on-going service provided to clients. Personal Data will not be passed on to any third party except to other companies within The Wills Register Group of companies, any payment collection service for the purposes of obtaining payment for the will or any business partner of The Wills Register. We will only keep information about you for as long as we deem necessary. The Wills Register may use technology to track the patterns of behaviour of visitors to the site and this can include using a 'cookie' which would be stored on your browser.   13. The Wills Register reserves the right to change these terms and conditions without notice.
  14. These terms and conditions are subject to the law of England and Wales and any disputes will be dealt with by the Courts of England and Wales.
  15. Any provision of these terms and conditions which are declared void or unenforceable by any competent authority or court shall to the extent of such invalidity or unenforceability be deemed severable and the other provisions of these terms and conditions shall continue unaffected.
  16. The Wills Register shall not have any liability whatsoever or be deemed to be in default for any delays or failure in performance under these terms and conditions resulting from acts beyond its control, including but not limited to acts of God, acts or regulations of any governmental or supranational authority, war or national emergency, hostilities (regardless of whether war is declared), blockage, embargo, labour dispute, strike, terrorist activities, accident, fire, electricity failure or power cuts or server malfunction.
